2010 Election Automation: Laway connection, arkila election!

This 2010 Election Automation has now made a very interesting turn. It’s laway connection and the whole thing was an arkila election. Confused with what I have just said? That was not the intent. I was confused. And reading the series of the entries on Ellenville, one commenter who was notorious at Reyna Elena was trying to push it on a different tangent. It’s more like – to hell with how the contract was drawn, let’s push the automation! Haller?! Kahit lopsided ang contract? Does the end (automated polls) justify the means (retarded contract)?

First, let me apologize ki Tita Ellen Tordesillas dahil I plagia-riced her entries na walang permiso! But I must do this. I have to. Para malaman nang mga tiga-Barrio ang latest sa Hello Garci Automation. Kung na-shock ang fallopian tubes kong nakabitay sa hita ko, I’m sure, luluwa ang mga mata nyo with this contract na lease lang pala ang mga equipments.

Last July 1, ibinalita ko senyo na posibleng maging manu-manu ang bilangan sa darating na eleksyon. Well, na-areglo ang mga sapakan at sabunutan. Nag-kiss ang make-up ang mga actor sa drama na to. At ngayon? Nabasa ko na:

Ang nanalo pala sa kontrata nang gobyeness totalling P7.2 billion pesos para i-otomeyt ang election eh makaka-kuha nang almost P3 billion pesos o kaya korenta porsyento (40%) nang halaga nang kontrata bago pa i-deliver ang 82,200 counting machines na gagamitin sa May 2010 elections. Source:

Base daw sa kontrata na pinirmahan noong Hulio 10, ang Comolec eh may I pay Smartmatic nang about P3 billion pesos na bayad sa mga dildo at masahe, este, goods and services pala, kasama na ang pag-start nang project.

The who?! The what?! Arkila lang sya? Lumuwa mata ko! We are not buying the machines? Ang akala ko talaga, mega-buy naten ang mga machines na to for future use. So given na arkila lang pala sya, meron lang daw mga certain modifications sa software dahil nga ginamet na to sa Venezuelan referendum. So mega-change na lang ang “Si Senor” to “Opo, Ma’am!” hahaha! Which was true! I checked the contract and this is what it says!

ARTICLE 5
RESPONSIBILITIES OF THE PROVIDER

5.1 The PROVIDER hereby agrees to supply, lease (with option to purchase) and provide to COMELEC, the Goods and Services as described in item 3.1, Article 3 (Scope of the Project) of this Contract.

5.11 All Goods or Equipment in the possession of COMELEC because of any election contest or audit requirement after December 31, 2010 shall be considered sold to COMELEC pursuant to its purchase option under this Contract, and COMELEC shall pay the corresponding price within the first five (5) business days of January 2011. In case the election protest was due to any defect in the machines or the system or that the audit will show the same, COMELEC shall return the machines to the PROVIDER for full refund.

Which means, dahil sa option to buy the chorvaloo, ang tunay na presyo nitech is (P7.2 billion original contract + option to buy) P 9 billion!

And here’s how he dissected the rest:”

Project Inifialization, Set up Project Management Team (PMT) and Project Systems including all SW licenses & firmware 10%

Gawa na ito, from the Venezuelan referendum. It takes a few lines of programming code to change the choices from Si o No in the Venezuelan referendum to Erap, Chiz, etc.

Delivery of Development Set (20 units) 5%

Gawa na, courtesy of previous the Venezuelan referendum and other exercises. Besides, arkila lang, so ano ang binabayaran ng COMELEC?

Report on Transmission and Logistics 5%

Five percent of 7 Billion for a report? Anak ng kaputa-putahan.

Delivery of Functional System and Software Agreement 5%

Computerese. Hindi ba’t dapat kasama sa “Development set” ang software? Ano computer na walang OS (operating system)? Double dipping ito.

Delivery of EMS and CCS (HW, SW and Website) 5%

Website? Five percent of 7 Billion? Paggawa mo sa Pana (Bombay) yan, TY yan, just to get your business. I know, yung kakilala ko, ginawan ng Indian company ng kanyang New York lawyer website. TY.

Complete System Including Custornization and
Voter Education MaterialsIWebsite 5%

Paki-sub-contract sa akin please. I can easily translate your Venezuelan manual to English, Tagalog, Ilocano, and fractured Cebuano.

Field Testing, Mock Election, TEC Systems Certification, Training of Trainors 5%

You will certify your own equipment for another five percent? Triple dipping na. Mock elections? You are mocking our stupidity. We may be stupid, but not brain dead.

    hala. umuusok ang entry mo na to kamahalan. kinalawkaw ko na ang mga issue sa automated election pero ngayon ko lang nadinig na ARKILA pala ito.

    teka naisip ko paano na sa susunod na eleksyon, ganito ulit? hindi ako makapaniwala sa ginawa ng comelec. tsk tsk

      to adebrux’s comment on your entry, it (contractual pricing) is truly is a legit concern.

      there’s no denying that all of us are well aware about the “end” of this project and that is, to arrest the years of terrible and ridiculous counting and election protest to the point of wrestling the will of the people and proclaim fake candidates in position and hold on to powers that’s not theirs. and yes! there cannot be any glitches whatsoever!

      but at the same time, we all should be aware that this incident truly showed once again what we all know, what World Bank knows, what every sane and reasonable Pinoy person knows that our government contracting procedures and how it’s drawn is totally fkd-up and to this day, there seemed to be no improvements whatsoever! if it is, was it done in all expediency as not to look into the process itself?! now, that’s depending on what your definition of what process.

      so the next question becomes, who wrote the contract? who negotiated the contracts? how was it drawn? i believe that the thinking, negotiating and drawing of the contract itself to it’s awarding becomes the picture now and no longer the end for even if it serves the end, sinabi na nga dun sa previous entry ni Tita Ellen that you cannot make any short-cut of the law.

      this is the bigger picture in this deal. the ghosts of the past continue to swirl into every contracts.

    at ito ay ang testing. so, ibig sabihin, kailangan talaga naka-lease lang ang mga ito kasi, tetistingin pa nga lang sa may 2010 ang mga makinang ito. ngayon, kung pumalpak (tama at mabilis ang resulta ng election), eh di malaking gastos nga naman. testing phase pa lang, so bakit bibilihin na.

    nakaspecify ba kung ano ano ang mga makina na dapat hawak ng comelec. kung iisipin, di ba dapat computer lang o kaya server or hard disk na pinaglalagyan ng database at programs. yong mga scanners na napakadami, kung kasama man sa inarkila, kailangan pa ba yon kung meron election contest.

      So magiging testingan lang pala ang 2010 election,..at ang nakataya d2 ay ang bilyones na galing sa kaban ng bayan?… tapos kapag pumalpak ano ang mangyayari?… inavalid ang eleksyon at tuloy pa rin ang halakhak ng mga alipores ng kasalukuyang gobyerno?…. at pag minalas-malas mag aalsa ang taong bayan, at baka mauwi pa sa mas malala na sitwasyon.. nakaamba pala ang manganib na maaring idulot ng TESTINGAN na ito…

      Mabuti pa Umarkila na lang Videoke at magkantahan na lang, sabay inuman,.. enjoy pa ang taong bayan…. sinal-it ketdi nga biyag.

    Ang hindi ko matanggap, pinaubaya natin sa mga tapat at “magagaling” nating miyembro ng civil society na bantayan at gawing transparent yung bidding, awarding, at contract negotiations pero eto nga ang resulta. Okey sila sa lahat ng usapan, pagdating na sa papel, iba na ang laman.

    Tiwala na sana ako na ang pagpapa-sailalim ng NAMFREL sa ilalim ng PPCRV ay magbubunga ng maganda, incompetent din pala. Marami namang nagbo-volunteer gaya ng UP Computer Society, bakit hindi ginamit ni Tita De Villa?

    Wala na tayong hawak na baraha kundi umasa na lang na ipag-utos ng Supreme Court na baguhin ang terms ng kontrata. Tangna talaga, lagi na lang bang ganito?

      that was the most “unique” lease contract na nabasa ko ever! even yong line na pag lumagpas nang certain date na indi naibalik ang machines, will be considered SOLD. but of course, by that time, obsolete na siguro and the maker must have an upgrade so kelangang ibenta na! leche namang negotiations un!

      was it drawn that way para there would be no automated election at parang planted yong valid argument not to have an election?
