Anti-Child Porn Bill is Now a Law

President Gloria Macapagal Arroyo has finally signed into law the “Anti-Hentai” bill last Wednesday. Republic Act No. 9775 or the Anti-Child Pornography Act of 2009 penalizes offenders with one-month imprisonment to life sentence. The offender will also pay a fine of P300,000 to P5 million, depending on the gravity of the offense. (1.00 USD = 46.8096 PHP as of 11/21/2009)

The law defines child pornography as “any representation, whether visual, audio or written combination thereof, by electronic, mechanical, digital, optical, magnetic or any other means, of a child engaged or involved in real or simulated explicit sexual activity.”

Tarlac Rep. Monica Teodoro, one of the principal authors of the bill, said, “We used to be a haven for child pornography proliferators and foreign pedophiles, now our country is going to be a safe haven for children”.

Victims are recognized as “victims of a violent crime” and may claim for compensation before the Board of Claims under the Department of Justice.

The law mandates that child pornography victims be given emergency shelter or appropriate housing, counseling, free legal services, medical or psychological services, livelihood and skills training, and educational assistance.

The creation of an Inter-Agency Council Against Child Pornography was also mandated under the new law. It will have three representatives from children’s non-governmental organizations and would be headed by the secretary of the Department of Social Welfare and Development (DSWD).

Members of the council are the heads of the Department of Justice, Department of Labor and Employment, Department of Science and Technology, Philippine National Police, Commission on Human Rights, Commission on Information and Communication Technology, National Telecommunications Commission, Council for the Welfare of Children, Philippine Center on Transnational Crime, Optical Media Board and NBI.

Local government units, meanwhile, are tasked to regulate internet cafes or kiosks within their areas. Internet service providers, Internet content hosts, owners of mall, and other business establishments were likewise required to report any forms of child pornography committed within their jurisdiction.

Internet service providers (ISP) must report to the Philippine National Police or the National Bureau of Investigation (NBI) within seven days from obtaining facts and circumstances that any form of child pornography is being committed using its server or facility.


But wait… we already have a law about this right? Republic Act No. 7610 or the “Special Protection of Children Against Abuse, Exploitation and Discrimination Act”. So why make another law that’s full of loopholes? This new law literally makes loli-manga illegal and the mere possession of it will put you to jail. Be warned Siopao Master :P

Don’t get me wrong, but I think they should make new laws instead of re-branding existing laws. Reproductive Health Bill anyone? Or perhaps new cyber-laws that would put people like a known online stalker/harasser Tim Cumper to jail?

Well at least they’re not banning Hentai in general. That would make Rocky and Siopao Master sad… Right guys? ^_^
