In the news: 2 Ampatuans cleared of multiple murder charges

Zaldy and Akmad Ampatuan were cleared Saturday of the charges by the Department of Justice, with multiple murder in connection with the Nov. 23, 2009 Maguindanao massacre. Justice Secretary Alberto Agra ordered the dropping of multiple murder case against them for lack of evidence.

Should I be shocked with the news? Sabi ko na lang… “Ah, ok. Baka me project sa Maguindanao na 12-0. Question now: Who’s next for liberty, freedom and indignity to Filipinos?!

Here’s the story:

Agra said he granted the petition for review filed by Zaldy and Akmad because there was no proof that they have conspired with the others accused to ambush and kill 57 people, including the wife of Buluan Mayor Esmael Mangudadatu and 31 members of the media.

“I ordered the prosecutors to remove the names of Zaldy and Akmad Ampatuan from the list of accused. Mere relationship, having the same name does not establish conspiracy,” Agra explained.

Government witnesses claimed that on Nov. 22, the preparations for the ambush of the Mangudadatu convoy started.

Agra added that a certification from the Philippine Airlines showed that on Nov. 22, 2009, the suspended governor was in Davao City attending the Kanduli meeting with other regional governors.

On the date of the massacre, Nov. 23, Agra said a PAL certification showed that Zaldy Ampatuan flew to Manila from Davao.

He added that there was also a Smart Infinity statement indicating calls made from Manila to Davao but nothing from Maguindanao.

Agra also cited the certification of another witness on the governor’s presence during the meeting and that they flew together to Manila on Nov. 23.

On the other hand, Agra said he also granted the petition for review filed by Akmad because no witness ever implicated him in the massacre.

“He was not even named by the NBI (National Bureau of Investigation) and PNP (Philippine National Police) as respondent in the case,” Agra said.

However, Agra said he denied the petitions for review filed by former Maguindanao Governor Andal Ampatuan Sr., his son Datu Unsay Mayor Andal Ampatuan Jr. and Shariff Aguak Mayor Datu Anwar Ampatuan.

    Kampante umano si Maguindanao massacre prime suspect na si dating Datu Unsay Mayor Andal Ampatuan Jr. na ang mga miyembro ng kanyang pamilyang dawit sa kaso ng pagpatay sa 57 katao ay maaabswelto kapag si Nacionalista Party presidential bet Manny Villar ang mahahalalal sa eleksyon.

    Kinumpirma ni Andal Jr. na sinusuportahan ng kanyang pamilya ang kandidatura sa pagka-pangulo ni Villar sa isang panayam kamakailan ng ABS-CBN Channel 2.

    Sa naturang interview, ipinagyabang pa ni Ampatuan ang orange baller ni Villar bilang sagisag ng kanilang suporta sa kandidato ng NP.

    Pati umano senatorial bets ng NP ay sinusuportahan ng mga Ampatuan. Nagkaroon na umano ng sikretong kasunduan ang mga Ampatuan sa kampo ni Villar kaugnay nito.

    Kumalat ang mga espekulasyon na ipinangako umano ni Villar sa mga Ampatuan ang kalayaan o pagkaka-absuwelto sa Maguindanao massacre case kapag nanalong Pangulo kapalit ang panalo sa buong ARMM.

    Mas lalo pang lumatang ngayon ang posibleng da­yaan sa Autonomous Region of Muslim Mindanao na kontrolado ng pamilya Ampatuan pabor kay Villar at tumibay ang pagiging secret candidate ng NP bet, katulad ng alegasyong Villarroyo alliace.

    Bago pa man naganap ang karumal-dumal na masaker sa Maguindanao, naka-iskedyul manumpa sa NP ang buong pamilya Ampatuan sa pangunguna ni suspendend Maguindanao Governor Andal Ampatuan Sr., Andal Jr., at Autonomous Region of Muslim Mindanao Governor Zaldy Ampatuan na parehong nakakulong ngayon.

    It’s a bitter pill to swallow for the Filipinos especially the victim but I think the justice department got it right. Zaldy was somewhere else and did not even talk to his father and brother until after the fact. If he is guilty of plunder of ARMM economy or witholding evidence of murder or gun smuggling, charge him with that. If he was dragging his feet on the matter, charge him with that… but not murder unless there is anything that links him to it. AT THE END OF THE DAY, IT WILL JUST BE A WASTE OF OUR TAX MONEY AND RESOURCES BECAUSE EVEN A NEWBIE LAWYER CAN HAVE HIM ACQUITED FOR OBVIOUS LACK OF EVIDENCE LINKING HIM TO MURDER. The rumor in the south said that at one point, when father and son (Anda Sr. and Jr.) were talking about the disrespect of Mangudadatus (for running against them) it was Zaldy who said, why don’t you just let them run? They’re not going to win anyway.
