Aquino won’t recognize Arroyo chief justice

Liberal Party standard-bearer Senator Benigno “Noynoy” Aquino III warned Thursday night that, if elected President, he would not recognize any successor to Chief Justice Reynato Puno named by outgoing President Gloria Macapagal-Arroyo.

He also warned that any justice of the high court who accepts such an appointment from Arroyo “risks even his presence in the Court as an associate member” under an Aquino presidency.

“If elected President, I will not recognize a Chief Justice appointed by the outgoing President, contrary to the constitutional ban on appointments during the wee hours of her presidency, and contrary to propriety and delicadeza and long standing precedence of prohibition against appointments two months before the outgoing President’s term expires,” Aquino said in a statement sent to the Inquirer via text message by LP campaign manager Florencio Abad.

” Let me forewarn any member of the Supreme Court, who shall accept to be Chief Justice by appointment of the outgoing President, that not only shall he not be recognized, but he risks even his presence in the Court as an associate member,” Aquino added.

The senator issued the statement amid debates as to whether President Arroyo could still appoint a replacement for outgoing Court Justice Reynato Puno.

Puno is set to retire on May 17.

The Constitution prohibits the sitting president from making any appointment two months before she steps down from office.

What’s the basis of not recognising the appointment other than said appointment being made by the incumbent president?

Yet another case of the one-dimensional anti-incumbentism that no-substance “opposition” candidates tend to build their no-substance campaigns upon.

    Kawawang mama’s boy. :D

I’m beginning to like this guy, we’ll see. Hahaha! Paniki appointment! These people(Administration) are good at covering their asses. I do hope kahit magbago konti lang ang Pinas, else IMHO we do need a bloody civil war – we need cleansing folks. Historically real change is bloody. Okaay some might say everything is fluid; the bottomline is that we’re bleeding for years/decades, and since. In the old days they called it midnight appointments BTW, they need somebody in place to protect them in the future;-).

Noynoy’s comment is combined ignorance and arrogance. I dont want him to become President. At first, I am thinking of voting him since I dont want Villar to become president, but what the heck, I dont care if Villar win as long as I will vote the best and that is betwen Gibo Teodoro or Dick Gordon.
